
Judge delivers a massive blow to the defense's case in Johnny Gaudreau trial.
There has been an excellent development in the case of brothers Johnny and Matthew Gaudreau, both of whom were killed over a year ago now when they were struck by a vehicle while cycling by drunk driver Sean Higgins.
On Monday, Superior Court Judge Michael Silvanio made what could very well go down as a key ruling in the case when he declared that statements made by Higgins at the scene of the crime and during his interrogation will be admissible in court during the trial.
Higgins' defense attempted to argue that the statements should not be admissible as they were made at the scene of the crime prior to Higgins' being read his Miranda rights, but the judge disagreed and has ruled in favor of the prosecution in this matter. This is very likely to have a major impact on the case when you consider the fact that one of the statements that was being argued over was a clear admission of guilt on the part of Higgins at the scene of the crime.
"I hit ’em, I hit ’em, I hit ’em," said Higgins to a trooper on scene.
Higgins reportedly also admitted that he had been drinking prior to striking the two cyclists, another statement that will now be admissible during his trial.
"I did have a couple of beers in the car," said Higgins as per NBC.
"It had nothing to do with me drinking some beers today," Higgins added. "That really wasn't the problem."
Silvanio has previously ruled in the favor of the prosecution in this case including back in April when he rejected motions to dismiss charges against Higgins. Higgins now faces up to 70 years in prison if he is convicted of all charges after rejecting a plea deal he was offer which would have seen him spend just 35 years in jail in exchange for a guilty plea.
I can only hope that the Gaudreau family will get justice for the two young men that were so tragically taken from this world far too soon.
