New evidence creates a nightmare scenario for Gaudreau prosecutors

Defence evidence challenges a key assumption about where Johnny and Matthew Gaudreau were riding before the fatal collision.

The criminal case surrounding the 2024 deaths of NHL star Johnny Gaudreau and his brother Matthew took a significant turn this week as newly filed court documents introduced photos and diagrams that could undermine a central element of the prosecution's narrative.

The evidence, submitted by the defense team for accused driver Sean Higgins, includes images of the mangled bicycles the brothers were riding, the severely damaged front end of Higgins' Jeep Grand Cherokee, and detailed schematics mapping out where the vehicle and cyclists were positioned at the time of impact.

The critical issue comes down to location. Law enforcement has maintained that the Gaudreau brothers were riding on the shoulder of County Route 551 in Oldmans Township, New Jersey, when they were struck. But Higgins' defense argues the newly revealed schematics tell a different story.

A defense expert stated in the court filing that there is no physical evidence defining precisely where the point of impact occurred along the roadway. The expert further argued that available evidence suggests the cyclists were within the northbound travel lane, not on the narrow shoulder, immediately before the collision.

The expert called the assumption that the brothers were riding along the shoulder "bizarre and inconsistent with science and logic."

Higgins' legal team is also pointing to the absence of required bicycle lights and the darkness of the road as contributing factors. "Even when simply accepting the police analysis at face value, it is unclear how this analysis establishes that Mr. Higgins was responsible for the occurrence of the subject collision event," the defense expert wrote.

The photos included in the filing paint a grim picture of the crash's violence. One image showed a Trek road bike with its rear wheel missing and front wheel folded in half. Another captured a Cervelo triathlon bike with a missing saddle and warped rear wheel. Higgins' SUV sustained a cracked windshield and a crumpled front end.

Higgins, a 45-year-old army veteran, allegedly had a blood alcohol level of .087 at the time of the crash, just above the legal limit of .08. Prosecutors say he passed another vehicle on the road before striking the brothers, who were cycling back from their sister's wedding rehearsal dinner on Aug. 29, 2024.

Both Johnny and Matthew Gaudreau were fathers, husbands and sons. Johnny was a beloved figure in the hockey world, having played for the Columbus Blue Jackets and previously for the Calgary Flames.

The defense filed the documents on Oct. 5 as part of a motion seeking access to evidence prosecutors used in their crash reconstruction. Higgins' team wants to challenge that reconstruction with its own expert analysis.

Higgins appeared in court Monday afternoon, turning down another plea deal, and his trial is currently scheduled to begin Jan. 5. If the defense successfully casts doubt on where the brothers were positioned at the moment of impact, it could reshape the entire case moving forward.
